This agreement applies as between you, the user of this website (“User”), and AJ Studio Limited, the owner and operator of this website.

Your agreement to comply with and be bound by these Terms and Conditions is deemed to occur upon your first use of the Website, creation of an account, enrolment in a programme, subscription purchase, or payment.

If you do not agree to be bound by these Terms and Conditions, you should stop using the Website immediately.

No part of this Website constitutes a contractual offer capable of acceptance. Your enrolment, subscription, or purchase constitutes a contractual offer, which is accepted when AJ Studio issues confirmation by email or through the Website.

Where a programme has specific Terms of Enrolment or Programme Policies, those terms apply in addition to these Terms and take precedence where stated.

1. Definitions and Interpretation

In this Agreement, the following terms shall have the following meanings:

“Account”

means the personal information, login credentials, enrolment records, subscription details, payment information, and access permissions associated with a User on the Website.

“Content”

means all text, graphics, images, audio, video, lesson materials, curriculum resources, software, data compilations, and any other information appearing on or forming part of the Website or AJ Studio programmes.

“Facilities”

means collectively any online tools, learning platforms, booking systems, content libraries, communications systems, or services made available by AJ Studio now or in the future.

“Programmes” or “Services”

means all in-person, online, and hybrid educational programmes, school term classes, holiday programmes, workshops, events, subscriptions, and digital learning content offered by AJ Studio.

“Payment Information”

means any details required to process payment for Programmes or Services, including credit or debit card information or other approved payment methods.

“Premises”

means AJ Studio’s place of business located at Level 1, 427 Remuera Road, Remuera, Auckland 1050, New Zealand, and any additional locations used for programme delivery.

“System”

means any online communications or learning infrastructure operated or approved by AJ Studio, including booking systems, lesson platforms, messaging tools, and email communications.

“User” / “Users”

means any person accessing or using the Website who is not acting as an employee of AJ Studio in the course of their employment.

“Website”

means ajstudio.online and any associated domains operated by AJ Studio.

“We / Us / Our”

means AJ Studio Limited, a company incorporated in New Zealand.

2. Age Restrictions

The Website is intended for use by adults. Persons under the age of 18 may use the Website only with the knowledge and consent of a parent or legal guardian.

All enrolments, subscriptions, and payments must be authorised by an adult with legal responsibility for the participant.

3. Business Customers

These Terms and Conditions also apply to customers procuring Programmes or Services in the course of business, subject to any mandatory rights under New Zealand law.

4. Intellectual Property

All Content included on the Website or provided through Programmes, unless otherwise stated, is the property of AJ Studio Limited or relevant licensors and is protected by New Zealand and international intellectual property laws.

You may not reproduce, copy, distribute, store, record, or reuse any Content without prior written permission, except where permitted by law.

5. Third-Party Intellectual Property

Where Content belongs to third parties, all intellectual property rights remain with the relevant owners. Use of such Content is subject to the permissions granted by those parties.

6. Permitted Use of Content

Content may only be used for personal, non-commercial participation in AJ Studio Programmes, unless otherwise authorised in writing.

7. Links to Other Websites

This Website may contain links to external websites. AJ Studio is not responsible for the content, availability, or practices of third-party websites and does not endorse them.

8. Links to This Website

Links to the AJ Studio homepage may be made without prior permission. Deep linking to specific pages requires written approval.

9. Use of Communications Facilities

When using any System, Users must not submit content that is unlawful, abusive, defamatory, discriminatory, misleading, or disruptive.

AJ Studio reserves the right to monitor, moderate, and retain communications made through its Systems.

Information submitted through Systems may be used for operational or educational purposes, subject to the Privacy Act 2020.

10. Health, Safety, and Supervision

Parents and caregivers are responsible for ensuring that AJ Studio is informed of any relevant medical conditions, allergies, learning needs, behavioural considerations, or support requirements that may affect a participant’s safe participation in a programme.

Accurate emergency contact details must be provided and kept up to date.

AJ Studio provides supervision during scheduled programme hours only. Responsibility for participants outside scheduled programme times, including before drop-off and after pick-up, remains with the parent or caregiver.

In the event of illness, injury, or emergency, AJ Studio will take reasonable steps to respond appropriately, including seeking medical assistance where necessary. Parents or caregivers remain responsible for all associated medical costs unless otherwise required by law.

11. Accounts

Users may be required to create an Account to enrol in Programmes or access Content. Users are responsible for maintaining the confidentiality of login details. AJ Studio is not liable for losses arising from unauthorised account access due to User actions. AJ Studio may suspend or terminate Accounts for misuse, security concerns, or breach of these Terms.

12. Termination of Accounts

AJ Studio may terminate Accounts at its discretion, with or without notice, where reasonably required for operational, legal, or safety reasons.

Termination of an Account does not alter financial obligations already incurred under programme-specific terms.

13. Services, Pricing, and Availability

Programme descriptions are indicative and may vary to meet educational, operational, or safety needs. Programme availability is subject to capacity and confirmation. Prices displayed at the time of booking apply to that booking.

14. Enrolments, Subscriptions, and Programme Delivery

A binding contract is formed when enrolment or subscription is confirmed. Programme access may include in-person attendance, online lessons, and digital content. Enrolment secures a reserved place or access for the applicable period and is not a flexible credit system unless expressly stated.

15. Cancellation, Refunds, and Changes

Cancellation, refund, pause, and transfer rights are governed by the specific Terms of Enrolment or Programme Policies applicable to each Programme or subscription. Unless expressly stated otherwise, missed sessions are not refundable, partial attendance does not entitle Users to partial refunds, make-ups are discretionary, and subscription cancellation takes effect in accordance with the stated subscription terms.

16. Privacy

Use of the Website and Programmes is governed by AJ Studio’s Privacy Policy and the Privacy Act 2020 (New Zealand).

17. Use of Personal Information

Personal information is collected and used solely for programme delivery, account management, communications, and lawful operational purposes. AJ Studio does not sell personal information to third parties.

18. Disclaimers

AJ Studio does not guarantee specific educational outcomes. Website Content is provided for general information only.

19. Changes to the Website and Terms

AJ Studio may update the Website or these Terms and Conditions from time to time. Continued use constitutes acceptance of updated Terms.

20. Availability of the Website

The Website is provided on an “as available” basis. AJ Studio is not liable for outages caused by factors beyond its reasonable control.

21. Limitation of Liability

To the maximum extent permitted by law, AJ Studio is not liable for indirect or consequential loss. Nothing in these Terms limits rights under the Consumer Guarantees Act 1993.

22. No Waiver

Failure to enforce any provision does not constitute a waiver.

23. Previous Terms

These Terms supersede all previous versions unless expressly stated otherwise.

24. Third-Party Rights

These Terms do not confer rights on third parties.
